No i jest zadowolony

NORM: Jackson sees part of wish come true

Michael Jackson needed some marathon legal maneuvering to keep some intimate items from going to auction -- and to skirt cross-examination.

Attorneys negotiated from 8 p.m. Thursday to 2 a.m. Friday before reaching a settlement that allows Jackson to have a fraction of what he sought.

In return, he dropped his attempt to block the May 30-31 auction of Jackson family items at the Hard Rock Hotel.

Without the settlement in the courtroom of Clark County District Judge Elizabeth Gonzalez, he was heading for "a lengthy and exhaustive cross-examination," according to attorney Shawn Mangano.

The items that Jackson will receive include writings, drawings and notes, according to Mangano. "They were highly personal items he considered to be his."

They were among 20,000 Jackson family items discovered in an Oxnard, Calif., warehouse as part of a bankruptcy dispute. Mangano and his law partner, Jeff Sylvester, were representing Universal Express Inc., a Florida luggage transportation company that owns the collection.

The deal kept Jackson from appearing in court. Had he appeared, the plan was to escort him through the Clark County Detention Center for security reasons

Jackson Family Auction Underway at Hard Rock

May 30, 2007 07:26 PM

Auction buyers are spending thousands on Jackson family memorabilia at this moment. The Jackson family auction is still going on inside the Hard Rock Hotel and Casino.

The auction started 20 minutes late. Michael Jackson contested 12 items at the last minute in court, mainly his awards and handwritten notes from a difficult childhood period. Those were removed and the auction started.

Like the shopping day after Thanksgiving, buyers tried to be the highest bidder for Jackson family memorabilia. Some of the items represented Jackson 5 history. That drew fans for the most obscure members of the family.

Yvette Cameron, a Jackson family fan said, "I decided this morning that I was going to come out and see some of my husband's... supposed to be husband's.... suits, Jermaine."

Yvette Cameron was not disappointed. Camera in hand, she documented what was important to her and relived some childhood enthusiasm.

Others wanted to see something owned by the most famous Jackson... Michael.

There's a lot of memorabilia there but nothing says Michael Jackson like the signature jackets he wore in the mid-80's. One was black silk and custom made, and it's expected to fetch a huge price.

Even an MTV Video Music Award Moon Man for "We Are The World" went for $16,000.

Universal Express, which owns the item, fought off last minute legal appeals to stop the auction. The owner says the Jackson family frustration is misplaced.

Richard Altomare the owner of Universal Express said, "They get angry at the purchaser rather than the other father figure who lost it."

Richard Altomare says the memorabilia was forgotten in a New Jersey warehouse. He felt all of it would have been stolen had he not bought it following a bankruptcy.

Buyers didn't care where it came from, just that they could get what they wanted. It turns out two buyers are snatching up most everything. They could be representatives of the Jackson family. At this point, they aren't saying.

Część wywiadu z CNN, Altmore (Universal Express) i Brian Oxman ( prawnik rodziny Jacksonów) rozmawiają z Nancy Grace. Streszczenie w języku polskim później.

-----------------------------------------------------------------------------------

http://transcripts.cnn.com/TRANSCRIP.../30/ng.01.html

Aired May 30, 2007 - 20:00:00 ET

GRACE: Thank you. Question: What can you tell us about the auction happening over the next couple of days? What`s for sale, and how much do you expect to make?

ALTOMARE: Well, I think that what they`re going to see for the next day and a half is the museum-quality items of the collection. And I think that, when all is said and done, because the second phase will be some of the items that have been alluded to that are still in the warehouse, that we will come back and visit after this first stage is over. And, Nancy, I can promise you, it will be much more revealing for you than when Geraldo Rivera went into the vault.

And then we have a series of tapes and songs, some of which have been recorded and not released, some of which I think are just remarkable. And all of those masters are in the collection that Universal Express purchased. So I think the first stage, this museum quality, where we`re estimating somewhere between maybe $5 million and $10 million when all those items are sold.

And then, of course, you know, it`s a process, Nancy. It`s not going to occur in just two days.

GRACE: Also, joining us today, the Jackson family attorney. You know him well, veteran trial lawyer Brian Oxman.

Brian, thank you for being with us. Will Michael Jackson see any of this money?

BRIAN OXMAN, JACKSON FAMILY ATTORNEY: Nancy, we don`t think so. There has been a lawsuit that Michael filed, where he wanted to get back all of his personal items which were confidential, things such as bank statements and personal letters. He settled that lawsuit with these individuals.

The materials which are left there, Nancy, I have to tell you, are junk. There has been a sale of a Cleveland City Council resolution. It went for the great big price of $100. Randy`s bongo drums, which would sell in the store for at least $1,200 or $1,500, $550 at this auction.

I`m sorry. Diane is absolutely correct. We could have bought this for $25,000. All the family had to do was ante up. They said, "No way, it`s junk."

GRACE: Back to Mr. Altomare, who is conducting the auction, is it true that there are platinum records and stage costumes of Michael Jackson`s being auctioned?

ALTOMARE: Yes, of course, there are. And I do know that the first few hours of this auction have exceeded $400,000, or $500,000. So with all due respect to Mr. Oxman, I guess everyone has a different definition of junk.

I don`t know Mr. Oxman. We`ve never, you know, met. But I don`t know if this is the same Mr. Oxman that was sanctioned by the state of California for filing false reports on behalf of the Jackson family. It may not be the same.

GRACE: Well, obviously, that`s the same name, but in an entirely different matter. Back to you, Brian Oxman, to defend yourself?

OXMAN: You bet, Nancy. This family has been put through the wringer on this. We have things in this auction which never were in this storage cabinet. I have photographs of the storage cabinet. I`ve personally inspected it. The result is, is that things are being auctioned which we`ve never seen before.

The fedora hat, that was never in the storage cabinet. Supposedly Janet`s dancing shoes, excuse me, it was never in the storage cabinet. You can look through these photographs, which I have, and most of this material was never there.

Las Vegas Judge Rules Michael Jackson May Get Belongings Back
July 16, 2007

Michael Jackson may get his belongings back after a decision was made in court Monday. A judge ruled that the business, Universal Express, was in contempt of court and must return the items.

Universal Express held an auction in May for a collection of Jackson family materials it had previously purchased, but the company held some items back.

Jackson now faces another court date with Universal Express Friday in New Jersey. If the judge rules in favor of Jackson, he will get his belongings back next week.

Lawyer found in contempt in Jackson memorabilia case

LAS VEGAS (AP) - A lawyer was found in contempt of court for his handling of memorabilia owned by pop star Michael Jackson.

Clark County District Judge Elizabeth Gonzales, after a hearing Monday, said attorney David DeToffol violated her court order barring his client, Universal Express Inc., from selling or giving away some of Jackson's personal items.

The dozens of pieces of memorabilia, which include a Three Stooges collection and personal writings, still haven't been returned to Jackson. They're being held in a "secure location" at the courthouse, Gonzales said.

The controversy could be settled Friday in a New Jersey courtroom where a judge is handling another contempt of court case, the Las Vegas Review-Journal reported.

Jackson has been trying to get 25 pieces of memorabilia bound for the auction block returned to him since May, when he and Universal reached an agreement to return the items to him.

Universal had paid $5 million for the collection from a New Jersey businessman who claimed the property after the family failed to pay a storage unit bill.

On June 1, a day after the auction at the Hard Rock Hotel, Universal threatened to sue Guernsey's, the company handling the auction, if it didn't give the items back to Universal.

Gonzalez said that action violated her order prohibiting Universal from "selling, giving, conveying or transferring by any means" the 25 items.

Guernsey's, later turned the items over to the court.

DeToffol testified Monday that he didn't intend to violate the court order, but Gonzales, found otherwise.

She ruled that DeToffol will have to pay Jackson's attorney's fees and a $2,500 fine.

Ciekawe nowinki odnoście pamiątek i Richarda Altomare. Ktoś chciałby streścić w paru zdaniach? ;) ja niestety teraz nie mogę...

-----------------------------------------------------------------------------------------

As of May 3, 2008, Richard Altomare (former CEO of the now defunct Universal Express) is now spending quality time in a Manhattan jail, and he will remain incarcerated as such until he makes good on the roughly $1.7 million he owes for his string of provenly fraudulent activities, which not only led to the demise of Universal Express but also cost many investors and shareholders a ton of money based on Altomare's false promises and claims. Of the money owed. Richard Altomare has only paid $60,000 in the past year and claims to be unable to afford anymore, but a New York court found otherwise (he's got millions of dollars in assets, two expensive properties, recorded wages of $1.75 million on his 2007 taxes, etc).

Regarding the Jackson memorabilia auction from 2007, Altomare grossly inflated the actual value of the items in the collection and falsely claimed that they were appraised for up to $200,000,000. The actual price the entire auction netted was just $580,110 (he ended up deep in the hole after all expenses were paid for this collection). Altomare was found in contempt by a Nevada judge after trying to circumvent the agreement he and Michael Jackson had signed, by trying to auction off items that he knew he had no right to sell. Michael (and Janet) won the case against Altomare and Universal Express (Altomare ended up paying the legal fees to all parties), but now Henry Vaccaro has been allowed to intervene to try to win control of the remaining memorabilia (another court date on this matter is set for later this month).

Prior to all of this madness going down with Richard Altomare, he claimed to also have possession of many master recordings of unreleased tracks from Michael Jackson and the Jacksons, and that he was planning to sell them for millions to Sony etc... Michael Jackson's Nevada attorneys made it clear that each of these recordings are under copyright protection by Michael Jackson and the Jackson family and they could not, under any circumstances, be sold. Despite this, Altomare refused to provide their whereabouts and it is believed he tried to sell them "under the table" to anybody interested. However, in January of this year he was forced to turn them over to the court.
