Ciekawe gdzie oni znaleźli miasto LOS VEGAS???? :-)

Judge to Decide Award in Secret Taping in Michael Jackson Case

LOS ANGELES (AP) -- Talk about throwing yourself on the mercy of the court.

The owner of a charter jet company says he'd like a judge to decide how much he should have to pay Michael Jackson in connection with an incident during the pop star's arrest on child molestation charges.

The owner of the jet set up videotaping equipment to record Jackson and his lawyers during the flight from Las Vegas to his surrender in Santa Barbara, California.

The matter ended up in court and the jet's owner is now the target of a civil lawsuit. The jet company wants the judge to set punitive damages without hearing from witnesses who would have testified about his financial worth.

The judge has heard testimony in the two million dollar invasion-of-privacy suit, but hasn't ruled on it yet.

Damages against man in secret Jackson-Geragos video

A judge is scheduled today to consider levying punitive damages against a man who allegedly set up the secret videotaping of lawyer Mark Geragos and Michael Jackson aboard a private jet.

Los Angeles Superior Court Judge Soussan G. Brugera presided over a three-day, non-jury trial stemming from Geragos' lawsuit against Jeffrey Borer and XtraJet of Santa Monica. She took the case under submission Jan. 24 to decide both liability and damages.

On April 23, Brugera said she wanted to learn more about Borer's financial status so she can determine what amount of punitive damages should be assessed against him. She has ordered him to appear in court today with documentation of his financial assets for the past three years.

The taping occurred Nov. 20, 2003, as an aircraft owned by XtraJet took Jackson, Geragos and Geragos' associate, attorney Pat Harris, from Las Vegas to Santa Barbara so the singer could surrender in a child molestation case.

Geragos, Harris and Jackson sued Borer and XtraJet in November 2003 for invasion of privacy.

Jackson dropped out as a plaintiff in April 2005.

Brian J. Kabateck, the lawyer for Geragos and Harris, asked Brugera to award them $2 million in compensatory damages and punitive damages nine times that amount.

The unique question raised by the tape involves assessing what damage has been done to Geragos by it, according to the attorneys in the case. Although the tape's existence is known by millions, the small number of people who have actually seen it include the lawyers, the FBI and a few members of the media.

A judge issued an order shortly after the flight preventing the tape from being sold and it has never been broadcast.

Geragos was representing Jackson at the time, but the entertainer later replaced him with Tom Mesereau.

Borer's attorney, Lloyd Kirschbaum, said in April that Brugera's statements appear to indicate she has found Borer liable. But he said the real issues in the trial have always centered on damages since Borer has conceded he ordered that the videotaping be set up.

"This could mean there will be an order of pennies on compensatory and punitive damages, or millions in compensatory and punitive damages," Kirschbaum said.

Judge Orders XtraJet to Pay Up in Jackson Flight

A judge has ordered the former owner of a charter jet company to pay uber-attorney Mark Geragos and an associate lawyer $2.25 million for secretly taping them and Michael Jackson aboard a chartered plane as ***** was en route from Vegas to Santa Barbara to surrender to child molestation charges in November of 2003.

Geragos filed suit against the XtraJet, claiming the company videotaped the flight and tried to sell the tapes to the media for a sum in the high six figures. The lawsuit claimed this violated Jackson's right to privacy.

FOX News reported back in November of 2003 that the network had viewed the tape without audio and it showed a calm and often smiling and laughing Jackson drinking a soda and, at one point, spraying cologne.

Geragos had called the taping "one of the most outrageous acts I've seen in my 20 years of practicing criminal law."
